Terms and Conditions

Article 1 - Definitions
In these terms and conditions, the following definitions apply:

Withdrawal period: the period during which the consumer can exercise their right of withdrawal.
Consumer: the natural person not acting in the exercise of a profession or business who enters into a distance contract with the entrepreneur.
Day: 26-05-2025.
Duration transaction: a distance contract concerning a series of products and/or services, of which the delivery and/or purchase obligation is spread over time.
Durable medium: any means that enables the consumer or entrepreneur to store information addressed to them personally in a way that allows future consultation and unchanged reproduction.
Right of withdrawal: the consumer's option to withdraw from the distance contract within the withdrawal period.
Entrepreneur: the natural or legal person offering products and/or services to consumers at a distance.
Distance contract: a contract concluded as part of a system for distance sales organized by the entrepreneur, using one or more means of distance communication until the conclusion of the contract.
Means of distance communication: methods that can be used to conclude a contract without the consumer and entrepreneur being in the same room at the same time.
Terms and Conditions: the present general terms and conditions of the entrepreneur.

Article 3 - Applicability
These terms apply to every offer from the entrepreneur and to every distance contract and order between the entrepreneur and the consumer.
Before the contract is concluded, these terms will be made available to the consumer. If this is not reasonably possible, the entrepreneur will indicate where the terms can be accessed and sent free of charge upon request.
If the contract is concluded electronically, the terms will be made available in a format that allows storage on a durable medium.
If additional product or service terms apply, these will also be shared and, in case of conflict, the consumer may rely on the most favorable provision.

If any provision is found invalid or annulled, the rest of the agreement remains valid, and a new provision will replace it based on its intent.
Unregulated situations and unclear interpretations will be judged according to the intent of these terms.

Article 4 - The Offer
If the offer has limited validity or is subject to conditions, this will be clearly stated.
Offers are non-binding and may be adjusted by the entrepreneur.
Offers include a complete and accurate description of the products/services. Photos are a true representation but color deviations are not binding.
Obvious mistakes or errors do not bind the entrepreneur.
Every offer includes details on pricing, shipping costs, contract conclusion process, right of withdrawal, payment methods, contract duration, and other relevant information.

Article 5 - The Agreement
The agreement is concluded when the consumer accepts the offer and meets its conditions.
Electronic acceptance is confirmed immediately by the entrepreneur.
Until confirmed, the consumer may dissolve the agreement.
The entrepreneur takes security measures for data transmission and payment.
The entrepreneur may assess creditworthiness and refuse orders if necessary, with justification.
The entrepreneur will provide the following upon delivery: business address, withdrawal process, warranty info, terms recap, and cancellation rules.

For duration agreements, this applies to the first delivery only.
The agreement is conditional on sufficient product availability.

Article 6 - Right of Withdrawal
Consumers may withdraw within 14 days of receiving the product.
During this period, the consumer must handle the product carefully and only inspect it as necessary.
To exercise the right, the consumer must notify the entrepreneur in writing within 14 days and return the item within another 14 days.
Proof of timely return is required.
If the consumer fails to notify or return on time, the purchase is final.

Article 7 - Costs in Case of Withdrawal
Return shipping is at the consumer’s expense.
If the consumer paid for the order, the entrepreneur will refund the amount within 14 days after return, provided the return has been received or evidence is provided.

Article 8 - Exclusion of Withdrawal Right
The entrepreneur may exclude withdrawal for the following, if clearly stated in the offer:

Products:

  • Made to consumer specifications

  • Clearly personal

  • Perishable or with limited shelf life

  • Not suitable for return due to hygiene reasons and the seal is broken

  • Audio/video or software with broken seal

  • Newspapers/magazines

  • Subject to financial market fluctuations

Services:

  • Accommodation, transport, restaurant or leisure services for specific dates

  • Started with explicit consent before withdrawal period ended

  • Betting or lottery services

Article 9 - Pricing
Prices will not increase during the validity of the offer, except for VAT changes.
Variable pricing is allowed for market-dependent products.
Price increases within 3 months are only allowed if legally required.
After 3 months, price increases are allowed if agreed and the consumer can cancel.
No VAT is charged by the entrepreneur for deliveries outside the EU.
The entrepreneur is not liable for printing or typographical errors in prices.

Article 10 - Conformity and Warranty
The entrepreneur guarantees that the product matches the contract and relevant regulations.
Warranties do not affect consumer rights.
Defects must be reported within 14 days. Products must be returned in original condition.
The entrepreneur is not liable for misuse or unauthorized repairs.
Warranty is void in cases of third-party repairs, improper handling, or government-imposed material restrictions.

Article 11 - Delivery and Performance
The entrepreneur will handle orders with care.
Delivery address is the one provided by the consumer.
Orders are fulfilled within 30 days unless otherwise agreed.
If delayed, the consumer may cancel at no cost.
Refunds will be issued within 14 days after cancellation.
Substitute products may be offered; if so, this will be clearly communicated.
The risk of damage/loss passes to the consumer upon delivery.

Article 12 - Duration Transactions: Termination and Renewal
Consumers may cancel open-ended contracts anytime with up to one month’s notice.
Fixed-term contracts may be terminated at the end of the term.
Contracts cannot be automatically renewed for fixed terms, except in specific conditions for magazines or newspapers.
After one year, open-ended contracts may be canceled with up to one month’s notice.

Article 13 - Payment
Unless otherwise agreed, payments must be made within 7 business days from the start of the withdrawal period.
In the case of services, this starts after the consumer receives confirmation.
Errors in billing must be reported promptly.
If not paid, the entrepreneur may charge reasonable collection fees.

Article 14 - Complaints Procedure
Complaints must be submitted within 7 days of discovering the issue.
They will be answered within 14 days. If more time is needed, the consumer will be informed.
Unresolved complaints may become disputes.
Submitting a complaint does not suspend obligations.
If valid, the entrepreneur may offer replacement or repair at no cost.

Article 15 - Disputes
Contracts between entrepreneur and consumer are governed exclusively by Dutch law, even if the consumer resides abroad.

Article 16 - CESOP
Due to legal changes from 2024 under the Payment Services Providers Directive, payment providers may report transactions to the European CESOP system.
